ORDINANCE NO. 2782

AN ORDINANCE ON EMERGENCY MANAGEMENT IN RESPONSE TO COVID-19 PANDEMIC

BE IT ORDAINED BY THE BOARD OF ALDERMEN FOR THE CITY OF SAVANNAH, MO, as follows:

WHEREAS, on April 30, 2020 the Andrew County Commissioners enacted Ordinance No. 2020\3-COVID-19 pursuant to the authority granted under Section 192.300, RSMo., to enhance the public health and prevent the entrance of infectious, contagious, communicable or dangerous diseases into the County of Andrew, Missouri;

WHEREAS, the City of Savannah, Missouri, in full support of the actions taken by the County Commissioners, enacts the same aforementioned Ordinance as adopted by the County, which is narrowly tailored to protect the safety and welfare of inhabitants of Savannah, Missouri; and

NOW, THEREFORE, BE IT ORDERED BY THE BOARD OF ALDERMEN FOR THE CITY OF SAVANNAH, MISSOURI, AS FOLLOWS:

Section 1

The Board of Aldermen of the City of Savannah with this ordinance adopts the Andrew County Plan for Response and Recovery to COVID-19 Phase | as presented by the Andrew County Health Department and subsequent phases as required.

Section 2

All residents and visitors of the City of Savannah shall abide by the Andrew County Plan for Response and Recovery to COVID-19.

Section 3

The Savannah Police Chief, or his officers, have the authority to enforce the provisions of this Ordinance subject to the laws of the State of Missouri;

Section 4

A violation of this Ordinance shali be punished by a fine not to exceed five-hundred dollars and zero cents ($500.00) per day of violation. For purposes of calculating the penalty for violating this Ordinance, a month constitutes thirty 0) days.

Section 5

The Savannah Police Department, the Savannah Prosecuting Attorney’s office, Andrew County Health Department, the Board of Aldermen of the City of Savannah, and any other city employee or agent shall be immune from personal liability for enforcing the provisions of this Ordinance subject to the laws of the State of Missouri.

Section 6

This Ordinance shall immediately be in full force and effect at [2:00 am Monday May 4, 2020.

Section 7

This Ordinance will remain in effect until all phases of the Andrew County Plan for Response and Recovery to COVID-19 have been completed as agreed upon by local leadership, each phase will be reviewed at a minimum of every 2 weeks.
