ORDINANCE NO. 2020/03-COVID-19

ANDREW COUNTY ORDINANCE ON EMERGENCY MANAGEMENT IN RESPONSE TO COVID-19 PANDEMIC

An ordinance of emergency management in response to COVID-19 pandemic that jeopardizes the safety and welfare of the inhabitants of Andrew County, Missouri.

WHEREAS, The Andrew County Commission have the authority pursuant to the provisions of state law including, but not limited to, Section 192.300 RSMo. To make and promulgate orders, rules or regulations, respectively as will tend to enhance the public health and prevent the entrance of infectious, contagious, communicable or dangerous diseases into the County of Andrew, Missouri; and

WHEREAS, the proclamation declaring a State of Emergency currently in effect authorizes the Presiding Commissioner to take all necessary action to protect Andrew County residents;

NOW, THEREFORE, BE IT ORDERED BY THIS HONORABLE COMMISSION OF ANDREW COUNTY, MISSOURI, AS FOLLOWS:

Section 1

The Andrew County Commission with this ordinance adopts the Andrew County Plan for Response and Recovery to COVID-19 Phase I as presented by the Andrew County Health Department and subsequent phases as required,

Section 2

All residents and visitors of Andrew County shall abide by the Andrew County Plan for Response and Recovery to COVID-19.

Section 3

The Andrew County Sheriff, or his deputy officers, have the authority to enforce the provisions of this Ordinance subject to the laws of the State of Missouri;

Section 4

A violation of this Ordinance shall be punished by a fine not to exceed five-hundred dollars and zero cents ($500.00) per day of violation. For purposes of calculating the penalty for violating this Ordinance, a month constitutes thirty (30) days.

Section 5

The Andrew County Sheriff office, the Andrew County Prosecuting Attorney office, Andrew County Health Department, the Andrew County Commission, and any other county employee or agent shall be immune from personal liability for enforcing the provisions of this Ordinance subject to the laws of the State of Missouri,

Section 6

This Ordinance shall immediately be in full force and effect at 12:00 am Monday May 4, 2020.

Section 7

This Ordinance will remain in effect unti! all phases of the Andrew County Plan for Response and Recovery to COVID-19 have been completed as agreed upon by local leadership, each phase will be reviewed at a minimum of every 2 weeks.
